Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VoyBulk platform, including the website at voybulk.com and the web application (collectively, the "Service"), operated by VoyBulk ("we", "us", "our"), based in Dubai, United Arab Emirates.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

VoyBulk provides free online tools for dry bulk shipping professionals, including:

• Voyage estimation and TCE (Time Charter Equivalent) calculation
• Laytime and demurrage calculation
• Port-to-port sea distance calculation
• Vessel position tracking and cargo order management
• Port Distance API for programmatic access to sea distance data

2. Account Registration

To access most features, you must create a free account. You agree to:

• Provide accurate information at registration
• Keep your password confidential and not share it with others
• Notify us immediately at info@voybulk.com if you suspect unauthorised use of your account
• Be responsible for all activity that occurs under your account

One account per person or organisation. Creating multiple accounts to circumvent API rate limits or other usage restrictions is prohibited.

3. Acceptable Use

You may use the Service for lawful maritime business purposes. You agree not to:

• Scrape, crawl, or systematically download data from the platform beyond normal use
• Attempt to reverse-engineer, decompile, or extract the routing algorithm or port database
• Use automated tools to exceed API rate limits or circumvent access controls
• Upload or transmit malicious code, viruses, or harmful content
• Use the Service in connection with any illegal activity or to violate any applicable sanctions
• Misrepresent your identity or impersonate any person or organisation
• Resell or sub-license access to the Service or API data without written permission

4. Intellectual Property

The VoyBulk platform, including its design, code, routing algorithms, and port database, is the property of VoyBulk and is protected by applicable copyright and intellectual property laws.

You retain ownership of the voyage data, cargo orders, and calculations you create and store on the platform. By saving data on VoyBulk, you grant us a limited licence to store and process that data solely to provide the Service to you.

You may not reproduce, distribute, or create derivative works from the platform or its data without our prior written consent.

5. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or completeness of distance calculations, bunker prices, or port data
• Fitness for any particular commercial purpose
• Uninterrupted or error-free operation

We do not guarantee that the Service will always be available. Planned and unplanned maintenance may result in temporary unavailability.

6. Limitation of Liability

To the maximum extent permitted by applicable law, VoyBulk shall not be liable for:

• Any commercial loss, loss of profit, or loss of business arising from reliance on VoyBulk calculations
• Any indirect, incidental, special, or consequential damages
• Damages resulting from demurrage disputes, incorrectly fixed cargo, or charter party disputes where VoyBulk calculations were used as a reference

Our total aggregate liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or AED 100 for free-tier users).

7. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will endeavour to give reasonable notice for material changes. Continued use of the Service after a change constitutes acceptance of the modified Terms.

The free tier of the platform is offered at our discretion. We reserve the right to introduce, modify, or remove features from the free tier at any time.

8. Termination

You may delete your account at any time. We may suspend or terminate your account if you breach these Terms, abuse the Service, or engage in conduct harmful to other users or the platform. Upon termination, your right to use the Service ceases immediately. Data deletion follows the schedule in our Privacy Policy.

9. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless mandatory consumer protection laws in your jurisdiction require otherwise.
